Very long stories can do this, especially when there are cross-references or hyperlinks, etc.
I know that Adobe is working on improving performance. (If you join their prerelease.adobe.com program, you can test out their newest beta and give them feedback on whether it’s working better.)
In the meantime, one option is to break the stories down into smaller threads:

No, the Space Before feature does not affect a paragraph when it is at the top of a column. (Or at least it shouldn’t!)
You can probably just put one of these nested styles inside the paragraph style applied to the TOC paragraph, too, yes?

The easiest way to ensure they’re lower case and italic may be to do a find/change after the index is created.

The problem is that the paragraph style applied to your state subheads is set to span 2 columns! That created a “zone” so that the text couldn’t flow into it.

Sadly, we have not been involved with the ACE exams for a number of years, and I am not sure what the status is. I have heard that the exam has a lot of problems. I’m sorry to hear you had problems with it.
Have you considered the ACA exam instead? That might be a better solution.
