A nav TOC cannot contain images, only text. Part of the EPUB specification.

Your HTML TOC, should you decide to include one, can contain images.

Turn off the Adjust Layout checkbox in Layout > Margins and Columns before changing the margins and columns; it’s on by default. Is that what you’re asking?

strange! Wondering if it’d work okay if you exported to EPUB 3.01.

This is an obnoxious BUG in InDesign CC 2018. It has to do with choosing CSS Size set to Relative in the EPUB Export Options dialog box. If you choose Fixed, the “position: absolute” attribute isn’t written, and the validation warning goes away.

I haven’t tested, but I’m thinking you could find/change that attribute in the CSS to fix it after the fact.
