Another conditional formatting might be helpful (yes, for lists): The option to automatically restart numbering in lists if the current paragraph isn’t after another “list paragraph”.
Just had all lines of the TOC align to baseline grid, so no matter the space before or after or even the leading, as long as it didn’t go beyond the amount of the grid, all lines appeared beautifully and evenly spaced.
I had the same problem a while ago, at the end I simply aligned it to a baseline grid, it worked wonderously.
The whole frame isn't in its proper place.
