The Designer’s Dream Giveaway Competition Official Rules

Official Rules
NO PURCHASE NECESSARY. A PURCHASE DOES NOT IMPROVE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. Introduction
The “Designer’s Dream” Design Competition, (“Competition”) sponsored by Pantone, Inc., (“Sponsor”) is a promotion in which one Prize Package (as defined below) will be awarded to one Competition winner who submitted an original design using PANTONE® tools and PANTONE Colors in accordance with these Rules and is chosen by a panel of judges.
2. Eligibility
The Competition is open to all legal residents of the United States at least 18 years of age at time of entry. Employees of Sponsor, CreativePro.com and/or their respective parent companies, and each of their respective affiliates, subsidiaries, advertising and promotion agencies, and members of their immediate families, regardless of whether they reside in the same household, are not eligible to participate (“Excluded Parties”).
3. Timing
Competition begins at 6 a.m. PDT on June 1, 2009, and ends at 11:59:59 p.m. PDT on June 29, 2009 (“Competition Entry Period”). CreativePro.com reserves the right to extend the contest deadline, and will make the extension details available if this occurs.
4. Eligible Design Submissions
The Design Submissions must be created by you using at least one PANTONE Color and/or PANTONE tool.
Contestants must declare which PANTONE Colors and/or PANTONE tools were used in their design submissions, and explain how PANTONE tools were an integral part of the project.
Though not required, you may also discuss how using Pantone tools enabled multimedia design, enabled more precise communication through color selection, saved time and money, list what client the project was for, and list out whether you work for a particular design firm.
You may submit as many different designs as you like.
5. How to Enter
Send an image of an original design created by you using PANTONE Colors/PANTONE tools, then tell us about the project and how PANTONE played an integral role in your design. Feel free to be creative. Include any PANTONE Colors and PANTONE Tools used in your design. If possible, list out any multimedia components to the project. You must submit this information via the Web form at https://creativepro.com/article/designers-dream-giveaway.
Final designs must be posted by 11:59:59 p.m. PDT on June 29, 2009. However, see Section 3, Timing, regarding a possible deadline extension.
If the design is produced by more than one person, all such persons must submit as a team under the team name. Sponsor assumes no responsibility for disputes between persons claiming rights to the same design.
6. Judging
All submissions will be reviewed by a panel of judges appointed by CreativePro.com. Decisions of the judges are final. The Winner will be notified by July 13, 2009. If all attempts to notify a winner have failed, Sponsor shall have the right to select an alternative winner in accordance with this section.
Judging Criteria:
50% on best use of Pantone Tools/Colors
25% originality of design
25% creativity of design

No cash will be awarded in lieu of prize. Sponsor reserves the right to award alternative prize(s) of similar value. All taxes, fees and surcharges on prizes are the sole responsibility of winner.
8. Additional Terms and Conditions
Entrants acknowledge and agree that designs submitted by them including, but not limited to, third parties’ information contained therein, and/or entrants’ own names, likenesses and biographical information, may be used by Sponsor for public relations and/or promotional purposes such as on Sponsor’s Web Site, in professional magazines and in press releases and entrants hereby grant Sponsor a non-exclusive, royalty-free, sublicenseable and transferable, perpetual and irrevocable, worldwide license to use, reproduce, display, distribute and prepare derivative works from the above information in connection with Sponsor’s marketing and/or promotional activities in all media (the “License”). By submitting the designs, entrants warrant that they have the right to grant Sponsor the abovementioned License and that all necessary third party consents have been obtained. Entrants further warrant that their designs are original and do not infringe any copyright, trademark, publicity, privacy or other proprietary right of any third party.
By participating, entrants hereby agree to hold harmless and indemnify the Excluded Parties from and against any and all claims, suits, liabilities, losses, damages, harm, injuries, costs or expenses, including litigation costs and reasonable attorney fees, which Excluded Parties may incur in connection with (i) their use of entrants’ designs, third parties’ information contained therein, and/or entrants’ own names, likenesses and biographical information as provided herein, (ii) any allegation that the submitted designs violate the intellectual property rights of any third party, and/or (iii) from entrants’ acceptance, use/misuse of a prize.
If for any reason the Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Competition, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any E-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web Site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to, or resulting from, participation or downloading any materials in the Competition. Sponsor is not responsible for late, lost, illegible, incomplete, stolen, or misdirected entries. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Except where prohibited, each entrant agrees that this Competition shall be governed by the laws of the State of New York and: (1) any and all disputes, claims and causes of action arising out of or connected with this Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in New York, New York (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded and entrant hereby waives all rights to claim such damages and all rights to have such damages multiplied or increased.
9. Winning Notification
Winner will be notified privately in accordance with Section 6 above by June 29, 2009 and will be publicly announced by July 13, 2009.
